You were just leaving your friend's apartment building, when your foot catches on a broken stair board. You fall forward with your arms out stretched to catch yourself. Your forearm is fractured and your shoulder joint is torn.
You learn that your friend had told her landlord about that board at least a week before you fell. Her landlord was wrong to not immediately fix the problem, or block off the broken board. That landlord can be sued and the insurance company on that building made to pay for your pain, suffering, disability and any loss of income.

It could happen anywhere on a property, especially a business premises, which has a duty to keep its premise save for you as customers.
A perfect example of this occurred in the case of Stollar v. Cumberland Farms. Cumberland Farms put a cheaply built and poorly designed and constructed handicap ramp right in front of the exit door from one of its stores and right where cars drove. As she was leaving the store our client was watching for cars before she stepped off the curb. Unfortunately because of the poor design and construction of this ramp a foot came down on the side of the ramp that was made at much too steep an angle causing her to fall backward onto her rear end. She severely injured her back and neck from the impact of how she landed. Jeff Brody, settled this case at trial for $750,000. It was very gratifying that not only did our client get just compensation but also that Cumberland Farms replaced and relocated that ramp and now nobody else would be caused to suffer a personal injury because of it.
